Guy arrested for complying with Ohio’s identification law.
Michael Righi refused to consent to an unlawful search as he departed a Ohio Circuit City. The manager and clerk blocked his family’s car and try to force him to consent to a search of his property. In response he called to police who arrived ordered him to consent to the search which he refused. He followed Ohio’s identification law which specifically say that you must answer name, address, and date of birth to an officer, but you can refuse any other request for information. The officer demanded his driver license, which he refused. In response the officer arrested him without reading him his rights, seized his property, handed over to Circuit City to search and find nothing. Righi was then taken down to the station and booked on the charges of “impeding official business” after the officer realized that there is no law in Ohio to compel a person not operating a motor vehicle to present a driver’s license.
